December 7, 2007 Board Meeting - Chairperson Paul noted that at a Psychology Ethics conference, the subject of psychologists releasing raw test data to clients when requested was discussed. Dr. Paul remarked that the issue of A.A.C. § R4-26-106 had been previously discussed at the April 6, 2007 Board meeting. Dr. Paul noted that state law pre-empts our statutes and that psychologists are now required to release raw test data upon the request of the client as pursuant to A.R.S. § 12-2293.
House Bill 2115 - It was noted that the state Legislature had passed HB 2115 which affected A.R.S. § 32-2081(F)(3) and (G)(6). This new law gave the Psychologist Examiners Board the authority to issue a non-disciplinary order for a prescribed number of hours of continuing education in areas prescribed by the Board as a means of action in the culmination of an investigation.
House Bill 2786 - It was noted that the state Legislature had passed HB 2786 which became A.A.C. § R4-26-205 (B)(18) and references A.R.S. § 32-3211 about requiring a written protocol for the secure storage, transfer, and access of medical records.
